MUCH AUDO ABOUT NOTHING: metro railways: It seems now the T R S is very much concentrating on the Metro Railway Project Works which have already begun in the GHMC areas, even without fulfilling the terms and conditions of the contract agreement of the State/HMR made now with L&T; and on its routes; we hope he shall go in right perspective duly knowing what are the Court cases now pending in the Honorable High Court of A.P., what actually he meant to spell out about the metro railway, or about the tramway ; what does the Law, the Constitution of India, and the Schedules of the Constitution define and distinguish between the metro railway and the tramways ; under what authority and the Law a State like the Andhra Pradesh can go ahead with the construction Project for a Metro Railway; whether the A.P. State has passed any Law for this purpose to go ahead with construction of the Metro Railway fully owned by the A.P. State under the HMR command and control; whether the HMR can start the metro railways under the guise and cover of the A.P. State Tramways Act; Can the TRS or Mr. KCR or any of the other supporters can find out all these acts going un notices and with out proper chain and linkage system by some vested interests under name and style of HMR-Phase-I lands and the Phase-II lands made out and put together for handing over for construction of complex buildings/multistoried for commercial purposes which were already, to be earmarked to some interested parties in the name and style of metro railway station buildings arena. He shall first study as to what are the provisions and conditions made in the AP Tramways Act, and then about the Metro Railways Act,1978,2002,2009, its amendments and adaptation by the State Government for construction of the Metro Railways, and who shall take up the work, whether the AP State Govt., or the Centre, and what does the work of the Railways in this matter as per Constitutions and of the procedure to be followed by the Centre, the Parliament, the AP State Assembly, and lot of things before he actually takes up the issue of Metro Railway construction Project work in the GHMC/Hyderabad, Secunderabad area…

• There was some news: As" Namma Metro Bangalore” comes under the Mysore Tramways Act, certain amendments have to be made in the Act so as to bring it in accordance with the Metro Railways (Amendment) Act, 2009..How about this problem with - the Hyderabad (Andhra Pradesh) Metro Railway. Whether there were any such amendments to AP Tramways Act, or any other Act passed to tackle the issue arising out of or in the consequence of the words 'tramway' and metro rail' to make a legal cover to suit the tramways and the metro-rail-ways? Replacement of and go ahead with the metro rail in place of tram way? This is only an academic interest to know more about the action being taken by HMR also: The ways and means to get tramways changed over to metro rail for construction, operation and maintenance by the State may have to be looked into in new aspect as to whether any post facto Law made also be taken to make or have legal cover for all the things already taken up and implements for Metro Railways, and the amount of several corers of pubic money spent on this so far, which can also be brought to books; what provisions contained in the Constitution of India and how to apply them to cover legally, if need be to get some solution, if already made out , like some amendments, provisions, ipso facto to apply retrospectively, and available with you; if you are in possession of these matters kindly enlighten me to add to my knowledge. What are the Provisions contained for the Central Government, the States, the Union Territories about administration, establishment, maintenance and control of the Police/GRP/RPF conferment of powers for and to take care of the safety and security of the rail passengers on/over Indian Railways, Metro Railways, and the Tramways systems, not in a distribution and share model as is now going on, but to have a single Uniformed Force to take legal action on all sorts of Law and Order, Crime and other sorts, by a single Uniformed Force, whether under the Command and Control of the Centre or of the States; The idea to have 1500 marshals for Metro Rail construction Areas/cites coverage is found to be not a bad thing, but how& who can take care of the honest and sincere Contractors/Outsourcing Agencies for supply of this type of manpower; is there any such Agency, may be, I have no idea/knowledge, to come forward with fool-proof identity and certification of its legality and well being in all respects passing through the provisions as contained ,& laid down in the India's Private Agencies Security Act; What are the relation between the Union and the States/UTs on this matters as per the Constitution of India/and its Schedules; whether the State Government can out rightly take up the metro rail construction without the involvement of the CG/Ministry of Railways; if so under what provisions of the Law, or the Constitution; or are there any via media rules, Law to go ahead with the metro rail in place of tramways without any amendments in the Law or without prior sanction and approval of the Parliament or with out changing the Constitution to suit to the State to go with construction of the Metro railways in place of Tram ways. These are general topics we discuss, but could not get proper and correct path to move. What are the stipulations incorporated in The Schedules of the Indian Constitution about the Railways, the Metro Rail, and Tramways; who are empowered to construct, maintain railways, metro rail and tramways; what are the different provisions for them to adopt and apply for making a solitary unformed Police Force exclusively for the Railways; what are the differential points to identify these individual and or different aspects of working and under whose authority State or Central; Of late, since about 6 months or so, some intellectuals and interested parties are having some discussions on the matter of HMR and talking about the provisions of Law and other factors applied/applying or applicable to it, as is being seen for the Bangalore Metro Rail processing, and the applicability of above mentioned aspects for HMR. Everything shall be alright; there is no doubt about it, as long as it continues. But then who is going to bell the cat. please go through my emails being sent along with some attachments which may attract some provisions concerning and connected, HMR, Law, private security -insecure for the industry, safety and security of rail passenger and their belongs, and on crunch of matters; why they are side lining these issues, police and society, corruption, white collar crimes, private security system, intelligence and a lot other matters, go in between the lines do not discard any. I earnestly and sincerely pray you all to bestow some time on this hot topics and send your valuable views, comments, criticism, ways and means to adopt the same; pros and cons on this issue, etc..., not for some person's sake, but in the interest of he National prosperity and to save Nation's money ; You may go through some other Acts, like Metro Railway Act, 1978; 2002; 2009; and other Tramways Acts, including AP Tramways Act; vis-Ã -vis with provisions contained in the Constitution of India, etc so as to get benefit of your efforts by the commuters of HMR in near future. As I am interested that one shall not try to down grade the other, or try to find fault in the machinery of working system and lastly attribute corrupt practices and scam, as we seeing now, like in CWG, 2G,accusation on or over ˜1995 Purulia Arms Drop case, or luxury cars import scam case' wherein the DRI did not rule out the involvement of some embassies, etc.; Always try to uplift the right matters and respect them with least nods or so at the right time for prosperity without fear and favour, like wise one shall not focus on personal gains and/or material gain interests in weight but for prospective matters that the Organization shall come up like the Honest of all and above the sky. Instead of pin pointing and trying to find fault with other's views and vision on any matter if expressed, or trying to adopt ways and methods by trying or in clouding the Intelligence reports concerning to the men and materials or by fully depending on the others working capabilities, try always to find out factual matters even by going for GPS/GPSR vehicles and introducing ' Log Book system; try to go through them with patience and by that you may get some points to over come left behind or the matters you might have not tried to concentrate also may cone up much later on, keep a stock of every persons voices and the lot through cctv’s...why try to show mercy and sympathy, on whose cost, are they going to help the organization in future, nothing at all; while in inside or out side they try only to find fault, that is their nature, then why to continue, to dupe or drown.
• What are the provisions made out/contained in the Special Regulatory Commission proposed (2006) to be established to supervise Metro Rail Projects in India. Whether any such Metro Rail Projects Regulatory Commission has been set up as on date or not? If so may I get some points? Whether any enactment or any amendment has taken in the Metro Railways Act, 2009(to any other similar Acts, 2002, 1978 or other Acts) to incorporate or include exclusive powers for State Governmental Bodies to go ahead with Metro Railways with out previous sanction, approval or involvement of the Ministry of Railways for example: for the Andhra Pradesh - Hyderabad Metro Railways?::: or to that fact how about Jaipur Metro Rail of Rajasthan State: Whether any provision, amendment, or any other steps taken to apply Act. No: 34 of 2009 to Andhra Pradesh State in reference to its Hyderabad Metro Railway's construction in Hyderabad Metropolitan City.
• In my considered feeling and opinion, in Hyderabad /GHMC or to that matter any where one can underground on some special occasions, but can it be possible for the Metro Railways to go underground. Can the topography and geographical conditions especially in around Hyderabad one can find several numbers of hillock(s) ,may be ,at the same time, same length and breadth and even more the hillock might have spread over to some meters or even kilometers length by which ,even the foreign modeled machines ,may not be in a position to ditch the ground to the extent possible- say in-depth about 50-100 meters, to make it possible for laying out a tunnel for the purpose of running a metro railway tunnels, with sophisticated railway stations at every one kilometer length or so; Of course, only the expertise engineers and Geography Scientists can only determine about the fate and change over for a underground metro railways in GHMC Arena.
• With all these struggles and push and pull nature, let the Competent Authority shall decide whether the above mentioned doubts can be worked successfully towards going further with the metro railways in place of tramways as per the Law, the Constitution of India, the Schedules, defining on the point and question of metro railways, tramways, the Laws framed therein, an so on…

HYDERABAD METRO RAIL PROJECT PASSES A MAJOR HURDLE

Hyderabad: The Hyderabad Metro Rail project on Sunday passed a major hurdle with the South Central Railway (SCR) giving clearance to four Metro Rail crossings over the railway tracks in a proposal submitted by the HMR officials.
This is the first set of ‘general arrangement drawings’ (GAD) approved by the South Central Railway in a record two months after their submission. This will enable the HMR to build elevated metro rail crossings over the SCR railway tracks at Bharatnagar, Lakdikapul, Malakpet and Begumpet.
“Construction of elevated metro rail structures over the railway tracks is a critical activity determining the progress of the metro rail project and the early approvals accorded by SCR would enable speedy progress of the Metro Rail project,” said Mr N.V.S. Reddy, managing director, HMR.
Given the complex arrangements, technical complications and the legalities of ‘Right of Way’ as per the Indian Railways Act, railway clearance for elevated metro rail crossings over the railway tracks is normally a prolonged affair. The organizations seeking Right of Way permissions over railway tracks have to satisfy the stringent conditions of the Indian Railways codes and rules.
In a meeting with the HMR officials on Sunday, the SCR officials indicated that the approvals for the remaining crossing points at Alugadda Bavi, Chilkalguda, Oliphant Bridge and Wadi end of Secunderabad Railway station (western end) will be cleared shortly.
The railway authorities have accorded approvals for the first four Metro Rail crossings with the condition that proper integration of Metro Rail stations with the nearest railway station shall be achieved by HMR providing walkways, skywalks, parking facilities, etc. They have also stipulated that at Secunderabad station, the nearest Metro Rail station shall be connected to various platforms of the railway station with skywalks and escalators.
Mr N.V.S. Reddy said that the railway safety specifications, vertical (height) and horizontal clearances, infringement regulations etc., would be strictly adhered to.
